Acceptance of Terms

By downloading, installing, or using the Milo mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

Description of Service

Milo is a behavioral support tool designed to help you quit nicotine. The App provides features including craving tracking, guided breathing exercises, progress insights, and personalized support. Some features are available for free, while others require a premium subscription.

Medical Disclaimer

Please read this section carefully.

• Milo is not a medical device, medical service, or substitute for professional medical advice, diagnosis, or treatment.
• The App does not diagnose, treat, cure, or prevent any disease or medical condition.
• You should always consult a qualified healthcare professional before making any decisions about your health, including decisions related to nicotine cessation.
• Never disregard professional medical advice or delay seeking it because of information provided by the App.
• In case of a medical emergency, call your local emergency services immediately.

Subscriptions & Billing

Milo offers a premium subscription that unlocks additional features. The following terms apply to subscriptions:

• Premium subscriptions are available for purchase through the Apple App Store.
• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the same rate.
• You can manage and cancel your subscription through your Apple ID Settings.
• A 7-day free trial is available for new subscribers. If you purchase a subscription before the trial ends, the unused portion of the trial is forfeited.
• Subscription prices may vary by region.

User Responsibilities

When using Milo, you agree to:

• Provide accurate and truthful information.
• Keep your account and device access secure.
• Use the App only for lawful purposes and in accordance with these Terms.
• Not reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App.
• Not distribute, sublicense, or make the App available to third parties in any unauthorized manner.

Intellectual Property

All content, design, mascot artwork, trademarks, and code within the App are the property of Milo and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

Limitation of Liability

To the fullest extent permitted by applicable law:

• The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• We are not liable for any health outcomes resulting from your use of the App.
• In no event shall our total liability to you exceed the amount you paid for subscription fees in the twelve (12) months preceding the claim.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

Termination

Either party may terminate this agreement at any time. You may stop using the App and uninstall it at any time. We reserve the right to suspend or terminate your access to the App if you violate these Terms. Upon termination, your license to use the App ends immediately.

Governing Law & Dispute Resolution

These Terms are governed by the laws of the United States. Any disputes arising from or relating to these Terms or the App shall be resolved through binding arbitration in accordance with applicable arbitration rules, rather than in court. You agree to waive any right to a jury trial or to participate in a class action.

Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Your continued use of Milo after any changes constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.
